DanzStak is owned and operated by DanzStak LLC, a California limited liability company. These Terms of Service (“Terms”) govern your access to and use of danzstak.com and related DanzStak services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility and Accounts

You must be at least 13 years old and meet the minimum digital-consent age required where you live. If you are below the age of legal majority, a parent or guardian must review and agree to these Terms where required. You must provide accurate information, protect your credentials, and promptly notify us of unauthorized access. You are responsible for activity through your account unless caused by DanzStak.

2. The Service

DanzStak provides social networking, creator discovery, original-content sharing, persistent direct messaging, peer-to-peer WebRTC calls, events, bookings, and related community tools. Direct messages and calls are available only between accepted friends or members of a shared Tribe. Call participants are responsible for obtaining any consent required before recording or capturing a communication. DanzStak does not provide music-upload or music-streaming features. Features may change, be introduced gradually, or be discontinued.

3. Acceptable Use

You may not use the Service to:

• Break the law, facilitate crime, or infringe intellectual-property, privacy, publicity, or other rights.
• Harass, threaten, exploit, impersonate, defraud, or endanger another person.
• Post hateful, sexually exploitative, non-consensual intimate, terrorist, or violent content prohibited by law or our policies.
• Upload malware, probe systems without authorization, evade security controls, scrape at unreasonable scale, or disrupt the Service.
• Send spam, manipulate engagement, create deceptive accounts, or conduct unauthorized advertising.
• Collect personal information about others without lawful authority.
• Use music, artwork, recordings, photographs, or video without the necessary rights and permissions.

4. Your Content and Sharing License

You retain ownership of original content you create. When you post content, you grant DanzStak a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical formatting, display, distribute, and make that content available only as needed to operate, maintain, and secure the Service, including necessary processing by our hosting providers. You also authorize other users to reshare your public posts through DanzStak's built-in sharing features, subject to your audience and privacy settings. DanzStak does not automatically publish your content to external social platforms. This permission does not authorize another user to download, sell, separately license, or independently republish the full content outside the built-in sharing process.

The license ends when your content is deleted from our active systems, except for reasonable backup and legal-retention periods and copies or previews already shared by other users before deletion. You represent that the content is entirely your original work and that you have authority to grant this license.

5. Copyright and Content Rights

DanzStak does not accept standalone audio uploads or third-party copyrighted material. MP3, WAV, AIFF, and other audio-only files are prohibited. A user-created video may contain music only when that music is the uploader's original material. You may post only content created entirely by you. We may immediately remove suspected copyrighted material and restrict or terminate accounts responsible for violations. Copyright notices should identify the protected work, the allegedly infringing material, contact information, a good-faith statement, an accuracy and authority statement, and a physical or electronic signature, and be sent to DanzStak LLC, 2063 Main St. #237, Oakley, CA 94561, USA.

5A. Strict Copyright Rule

DanzStak permits only content created entirely by the account holder. Third-party copyrighted material is prohibited, including music, recordings, samples, performances, films, television, broadcasts, clips, photographs, artwork, writing, logos, and reposted social-media content. Users may not upload third-party material based on a claim of license, permission, fair use, commentary, or attribution. Videos may include only music created by the uploader. DanzStak may remove suspected copyrighted material immediately without prior notice and may suspend or terminate the responsible account. Standalone audio files and music streaming are not permitted.

6. Safety, Moderation, and Enforcement

We may review, limit distribution of, remove, or preserve content and may warn, suspend, or terminate accounts when reasonably necessary to enforce these Terms, protect the Service or users, comply with law, or address risk. Strict copyright enforcement includes immediate removal of suspected third-party material and account restriction for violations. We are not obligated to monitor all content and do not endorse user content. You may report concerns to DanzStak LLC, 2063 Main St. #237, Oakley, CA 94561, USA.

7. Third-Party Services

The Service may link to or integrate with third-party services. Their terms and privacy practices apply to them, and DanzStak is not responsible for third-party services, content, availability, or transactions.

8. Payments, Events, and Bookings

If paid features, tickets, subscriptions, or bookings are offered, prices, taxes, payment timing, cancellation terms, and any additional terms will be shown before purchase. Artists, venues, promoters, and users are responsible for their own offers, events, legal compliance, and performance unless DanzStak expressly states that it is the seller.

9. DanzStak Intellectual Property

The Service, software, design, trademarks, logos, and DanzStak-created materials are owned by or licensed to DanzStak LLC. User-created content remains owned by its creators. Except for the limited right to use the Service under these Terms, no rights are granted. Do not use DanzStak branding in a way that suggests sponsorship or affiliation without written permission.

10. Termination

You may stop using the Service at any time and may request account deletion. We may suspend or terminate access for material or repeated violations, legal requirements, security threats, prolonged inactivity, or discontinuation of the Service. Where appropriate and legally required, we will provide notice and an opportunity to appeal. Provisions that logically survive termination remain effective.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted operation, specific results, content accuracy, user identity, event performance, or that every defect or harmful act will be prevented. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, DanzStak and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenues, data, goodwill, or opportunities arising from the Service. Any aggregate liability will be limited to the greater of amounts you paid DanzStak in the 12 months before the event giving rise to the claim or EUR 100. These limitations do not apply where prohibited, including liability that cannot legally be limited.

13. Indemnity

Where permitted by law, you agree to defend, indemnify, and hold DanzStak harmless from third-party claims arising from your unlawful content, your material breach of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from DanzStak’s own conduct.

14. Governing Law and Disputes

These Terms are governed by applicable United States federal law and California law, subject to mandatory protections that apply where you live. No provision requires arbitration or waives non-waivable consumer rights. Mandatory consumer protections and rights to bring claims in your home jurisdiction remain unaffected. Before filing a claim, please contact DanzStak LLC, 2063 Main St. #237, Oakley, CA 94561, USA so the parties can try to resolve it informally.

15. Changes

We may update these Terms. We will provide reasonable notice of material changes where required. If you do not agree, stop using the Service before the updated Terms take effect. Continued use afterward constitutes acceptance where permitted by law.

16. General

If part of these Terms is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without permission; DanzStak may transfer them as part of a reorganization or business transfer, subject to law. These Terms and incorporated policies form the agreement concerning the Service.
